Workers' Compensation

Around 1911, Workers’ Compensation Insurance became mandatory for all employers in California. It’s there to assist you with medical treatments and benefits in order for you to return to your best ability on the job within a reasonable timeline. Workers’ Compensation is not a Personal Injury Settlement nor is it a retirement plan without a career-ending injury.

Medical Treatment

When the insurance company accepts liability, you are required to be treated within the Medical Provider Network (MPN). Utilization Review (UR) will determine what types of medical treatment are medically necessary. If your medical treatment is denied for your accepted Workers’ Compensation injury, we will file an objection called Independent Medical Review (IMR).

Injuries denied by the insurance company can be treated within a lien network of doctors who have agreed to treat injured workers on a lien basis. A lien claim is then filed on the case for medical treatment, and the insurance company pays, adjusts, and/or litigates the medical treatment lien. You will still receive all the benefits you are entitled to receive, but it may take longer if the injury is denied.

Disability

Disability encompasses how your injury keeps you from your job, both temporarily and permanently. When creating a workers’ compensation case, we need to calculate the percentage of disability caused by your work injury in order for you to receive your maximum benefits. The law recognizes many different types of disabilities, each with its own legal definitions and protections.

Settlements

With Workers’ Compensation settlements, your settlement amount will be agreed upon by all parties. If the parties cannot agree to a settlement amount, the Judge will intervene and decide based on the medical evidence, such as Qualified Medical Evaluator (QME) reporting and other factors. Lump sum settlements are meant to cover areas such as permanent disability (PD) and estimated future medical care (FMC). We are here to proudly represent you and to maximize your benefits.

Subsequent Injury Benefits Trust Fund

The Subsequent Injury Benefits Trust Fund (SIBTF) is a source of additional compensation for injured workers who are suffering from an injury caused by their original work-related injury. The Supplemental Job Displacement Benefit (SJDB) includes a non-transferable voucher for educational re-training or skill enhancement through a state-approved or accredited school. This is an option for workers who need to make a career change due to their injury. After receiving the voucher, you may be eligible for the California Return to Work Supplement program and payment. The voucher may or may not be part of your settlement as it subject to certain conditions to trigger the entitlement to the voucher.
